Child porn charges: possession, making available, distribution

A CTV reporter, Callam Rodya, was recently charged with child porn related charges. These are very serious offences and carry mandatory minimum sentences. That means no matter what, if found guilty, depending on the exact conviction, one could face anywhere from 90 days jail, 6 months jail, or even a year jail guarenteed. However, the Crown or prosecution is almost always asking for more jail. There are also life long consequences associated with being a registered sex offender and prohibitions to electronic devices and or the internet. If your charged with these kind of offences, it’s important to talk to an experienced lawyer who is familiar with the Charter, related case law, and available defences. Perhaps you were unreasonable searched, or did not have your rights exercised properly. Maybe there are delays in your case. Perhaps other people had access to your computer or electronic device. Perhaps the file that was downloaded was misrepresented as something else. These are all possible defences that a competent lawyer can advise you of when he or she reviews your disclosure. For whatever reason, some people are overcome with a huge feeling of guilt and just want to responsibility for their crimes. Am experienced lawyer is able to demonstrate the fralitities the Crown’s case and becuase of trialable issues, I’d often able to have a reduced sentence - sometimes by more than half of what is originally being seeked. Sometimes a lesser included or downgrades charge allows this.
